Justice Department to Restart Hate Crime Investigation in Trayvon Martin’s Death

WASHINGTON — The Justice Department said Sunday that it was restarting its investigation into the 2012 shooting death of Trayvon Martin to consider possible separate hate crime charges against George Zimmerman.
The federal inquiry, which was started shortly after the shooting last year but had been delayed while the state criminal trial in Florida was under way, was being restarted after civil rights leaders called on the Justice Department to re-examine the case. The leaders said Sunday that they remained convinced that the shooting had a racial element. Mr. Martin, 17, was black.
“There is a pattern of George Zimmerman making dozens of calls to 911 over several years, frequently about young men of color,” Benjamin T. Jealous, the president of the N.A.A.C.P., said in an interview on Sunday. . ...
Zimmerman is guilty of disparate impact in noticing things. Noticing things is a hate crime.
But the Obama administration’s Justice Department has been cautious in its use of the expanded law. In 2010, for example, it turned down calls by civil rights leaders to file charges in New York City in the 2006 death of Sean Bell, a 23-year-old black man who was fatally shot by police officers outside a Queens club just hours before he was to be married.
Yeah, but that's merely the little old NYPD. The Zimmerman Menace is the main threat to civil rights.

The U.S. Justice Department, which opened an investigation into the George Zimmerman case Sunday, could charge him with federal civil rights violations, local attorneys said.
While a Florida jury found neighorbood watch volunteer Zimmerman not guilty of second-degree murder, a federal probe would examine whether he violated Martin's civil rights when he fatally shot him Feb. 16, 2012, in Sanford, Fla.
To prove such violations requires a different standard of evidence and law than what was used in the state case against Zimmerman. So a federal prosecution would not be double jeopardy, they said.
Robert Valli, a Garden City-based civil rights attorney said if a probe proceeds, the local federal prosecutor would likely seek a grand jury indictment on charges that Zimmerman violated the federal Hate Crimes Prevention Act.
Valli said potential charges would be the government's "version of a homicide charge, coupled with the intention to do so because of the person's membership in a protected class."
Constitutionally speaking, wouldn't it just be simpler for Obama to order a drone strike on Zimmerman's condo?

In terms of dealing with the massive amount of immigrants in the last 20 years, this case is better for the Republicans than passing that bill. Immigrants want nothing to do with blacks and they don't get nagged with any moral sanctimony about it. They're watching the Democrats as the party of black people, the only people everyone fears might start a riot. The Democrats are stuck with the blacks and immigrants from India or whereever, even the Hispanics, won't cast their lot with the blacks. Everyone can see where the racial demagoguing has gotten black people.
U guys are headed the South Africa route. Here criminals are presumed innocent until caught with the jewelry or blood-stained gun in their hands. And even then they get off coz there is nobody to test the DNA (whites have been kicked out of the police). When someone is convicted, they magically escape from prison.
White victims are usually investigated for stuff like not having a gun license, or being racist to their black staff.
Essentially the laws make it impossible to have black labour, which is why the unemployment rate is at 70%.

He was found not guilty of the crime he was charged with and the other one the judge agreed that the State could add at the last minute (murder 2 and manslaughter). He was not found not guilty of any and all crimes he might or might not have committed.

I live and work in an area that is over 2/3 black and immigrant Hispanic Hispanic. I can't afford to be politically correct, nor is it possible to with reality in front of me eyes all day. Sullivan may have a thing for black men, but I would bet anything he doesn't live amongst them. And the same goes for all of the other heartbroken, outraged whites you've heard from in the past 24 hours.

As a married man, I feel for Obama. He just reached the pinnacle of occupational accomplishment (re-election to the Presidency) and his wife is still a brooding scowl monster. I would forgo 1 year's salary if I could get a quarter every time she began a sentence with "A real black man would..!" If this double jeopardy Federal trial were not forthcoming, I'd seriously expect divorce papers by the end of 2017. It was either this or several lonely weeks on the Lincoln coach.
Here's the relevant portion of the Federal Hate Crimes Law, 18 U.S.C. §249:
(a) In General
(1) ....Whoever, whether or not acting under color of law, willfully causes bodily injury to any person or, through the use of fire, a firearm, a dangerous weapon, or an explosive or incendiary device, attempts to cause bodily injury to any person, because of the actual or perceived race, color, religion, or national origin of any person-
I don't possibly see how Zimmerman could be charged again under this, the only remotely applicable civil rights statute. The mens rea here, willfulness, is exactly the issue which the jury was deciding.
This is true no matter which meaning you impart to wilfulness. In the criminal law context, it can mean either bare intentionality or evil purpose. In fact, without intending to, attaching the jury charge of manslaughter may have actually insulated old Georgie from prosecution under the Hate Crimes act. That's because the jury, in addition to hearing the instructions regarding ill will and spite relating to the 2nd degree charge, also heard the manslaughter charge, which required them to consider whether "Zimmerman intentionally committed an act or acts that caused the death of TM."
They found him not guilty on both charges. Therefore, the Florida jury has already determined that he didn't act willfully.
You can't satisfy the elements of the federal statute if you don't have willfulness. The jury considered and rejected that Zimmerman acted willfully. Trying him under the Hate Crimes Act would very clearly be double jeopardy.
That doesn't take anything away, of course, from all those who have pointed out that the fact this is simply being considered is a sign of how far the rot has set.

Wonder what fraction of burglary convictions in Sanford, and specifically Zimmerman's gated community, are against blacks. Wikipedia says Sanford is 30.5% black, and Seminole County is 11.1% black. Wouldn't be shocked if > 90% of Sanford burglaries are due to blacks. Having that stat pointed out in a civil rights trial might not be what the Obama Administration has in mind.
Obama/Holder are playing with fire with this one. George Zimmerman has been acquitted, and a very large portion of America, including all Republicans and most swing voters, are absolutely ready to accept that he's innocent. This isn't one of those minor scuffles the public will ignore. This will be front page news, and it will make Obama and Holder look like the racist, race-agitating, anti-American radicals they are. Just what the Republicans want in time for the 2014 elections: an Obama-voting martyr that makes Obama and the Dems look bad.
What it most closely reminds me of is the Racial Justice Act in North Carolina, which freed several black murderers from the death penalty based on "disparate impact" caused by supposedly racist jurors. It may have been a major reason why Republicans retook the governorship for the first time in 20 years and saw their majority in the NC House increase from 68 of 120) to 77.

First you told us that the jury of 6 women would convict Zimmerman. They found him not guilty. Then you told us that Holder will charge Zimmerman in a Federal suit and that Zimmerman "has no chance there", which I guess means conviction. Neither of those two things has happened yet. No federal charges have been filed, though they might be in the future. I would guess that the probability of conviction on hate crime charges is low. Where's the evidence of "hate speech"?

In our national discussion on race and guns, can someone please, please tell me why so many so-called "men" feel so insecure and threatened by young urban black males that they risk jail-time and self-inflicted gunshot wounds in order to carry firearms? Though Zimmerman looks Mexicanish, he's actual of Peruvian descent, and most Hispanics in America are not from Peru. So, most Mexican-Americans didn't care. Also, Florida is not a Mexican heavy state.

It really is hard to see what the crime was. The only line we're being given at present is "we are investigating to see if Zimmerman violated Martin's civil rights." Maybe if you shoot a person in a "protected class," whatever the circumstances, you are "guilty" of the "crime" of "civil rights violation." If so, this would simply amount to blacks' being inviolable royalty.

If Hispanics won't cast their lot with the Blacks, why do the number of Hispanics who are pro-Trayvon Martin vastly outnumber Hispanics who are pro-George Zimmerman.

Federal Hate Crime laws were written specifically to make the Constitutional prohibition on double jeopardy a dead letter if the federal government wants to prosecute someone for political reasons (read: if you're the wrong kind of white person, or in Z's case, a pseudo-white for purposes of sustaining The Narrative). It's not constitutional according to the letter of the law; it's constitutional according to our "living constitution" as defined by Rabbinical hair-splitters who specialize in inverting and perverting the spirit of the law. So citing the law is beside the point; the law is whatever the lawyers and judges say it is. And they say it ain't double jeopardy. Or they'll try to anyway.

My prediction is that the Feds will make a show of "investigating" Zimmerman to appease the immediate anger of Obama's base, but that once things have had a chance to cool down, they will announce that they don't have enough evidence and end the investigation. I guess they could charge him but they run the risk of getting the whole law tossed out of court. They would only be charging him on his supposed views not on the killing. That is to say they want to charge him for following Martin because he was Black.
Zimmerman is a private citizen he can hold any biases he likes. He is well within his rights to follow Martin. A federal judge or jury would simply laugh at this case. I suspect the real risk of jeopardizing hate crime laws will keep Holder in check but who knows with these guys.

I'd be surprised if the hate crime prosecution goes much further. My track record for these kind of predictions hasn't been very good but here goes.
The Martin-Zimmerman incident is sharply divisive along racial lines. All blacks it seems are convinced that Zimmerman did something wrong. Many advocate that some black street thug murder sweet pudgy George. So if you want to appeal politically to blacks you would prosecute Zimmerman for anything you could dream up.
But all blacks are already going to vote for Obama backed candidates in the upcoming elections. You might think that because blacks like everyone else have been losing their enthusiasm for Obama that he might pursue Zimmerman so as to 'prop up his base'. There could be some of that but blacks are already energized along racial lines. Obama has already benefited from this case simply because it has driven Benghazi, Fort Hood, and the IRS scandals off the air. He could have Eric Holder flay Zimmerman alive on the White House Lawn and he would not get anymore black votes - there aren't anymore to be gotten.
This case seems to be splitting off many white liberals from the blacks among the Obama supporters. The case for self defense is simple and obvious. You have to actually be black as to be able to overlook that. Many white liberals can't manage to hold their nose and condemn Zimmerman for the sake of the Democrat Party.
It is probably a mistake for Obama to ally the Zimmerman case with the gun control issue. The whole Second Amendment issue is now and has always been based on fear of violent Negroes. George Mason and the Virginia planters were strongly in favor of an armed militia because they feared a slave insurrection. This fear still resonated with the Tea Party and a host of other groups during the recent gun control debate. The home defense rational means fear of black home invaders.

Month 1- "A crazed white vigilante murdered an innocent, angelic boy!". Then it turned out that Martin wasn't so innocent or angelic, and was for all practical purposes a man, not a boy. Zimmerman was also revealed to be not so crazed and not so white. So that angle was dropped.
Later- "It's those awful 'Stand your Ground' laws, that's what's wrong!". But the defense didn't even need to mention that law at trial, because was totally irrelevant to the case. That line was abandoned pretty swiftly by the smart media players, though some stragglers still haven't wrapped their heads around it yet.
During the trial (after it became clear that there was no way to prove murder)- "Zimmerman recklessly provoked a confrontation, ignoring police instructions!". But police testified that he cooperated fully and followed all their instructions, and the jury subsequently agreed.
After the acquittal- "Anyone who is going to carry a deadly weapon should be more careful, and more knowledgeable!" i.e., GZ was a little bit of a bumbling incompetent, which is more-or-less true.
This kind of "outrage distillation" is common when the press push a bull***t narrative and then discover that they were mostly wrong. The can't continue lying, but they can focus the same amount of anger and opprobrium onto smaller and smaller sins.

Yes but bear in mind that most people don't pay full attention to the news and pay most at the beginning of a story so that first version is the one that has stuck most in the minds of people like that who only read mainstream or overtly liberal media.
I have relatives who only vaguely followed the story and they all thought Martin was like the 12 year old kid in the photo the media used everywhere - even in Europe btw. They all use the 12 year old photo.

That's my guess too. The only reason for pursuing it further would be to punish Zimmerman for killing a black guy, but as others have pointed out, these people don't care about blacks getting killed every night in Chicago. This was about political advantage, and there's just no more political hay to be made here anymore. Too many people have seen pictures of Zimmerman and realized he's not the white supremacist gun-nut that was implied, and those numbers (and the number of people seeing recent pictures of Martin) would only grow in a second trial.
So my guess is that they'll make some loud noises about investigating it thoroughly, suggest that that will take a while, and assume that everyone will have forgotten about it a month from now.
It might be that this is just a tactic by the administration to let the situation cool down slowly. Kind of like the theory that whites are protesting so that blacks won't riot.
If the administration makes the right noises, they can aim for a soft landing to the crisis, rather than a crash and burn.

The Sanford Police did not withhold evidence and neither did the local state's attorney's office. This misfeasance was the work of the special prosecutor's office.
Federal civil rights charges are humbug. Martin was not killed undertaking any sort of civil activity and Zimmerman is not a public official. It has been suggested that they would collar him with federal 'hate crimes' law, but they would have to come up with evidence that the diffident Mr. Zimmerman was peculiarly hostile to anyone. The only thing the feds could do with an honest federal district judge looking over their shoulder is to attempt to extort some sort of plea through driving him further into insolvency and/or to get his lawyers to bail for economic reasons. No, there would be a country-wide campaign to erect metropolitan police departments, staff them well, and hire disciples of William Bratton to run them. That this is not done is a function of institutional defects (structural and cultural), vested interests, and penny-wise foolishness on the part of suburban voters.
Have others noticed how many numbskull reporters think a criminal prosecution for a civil rights violation is a "civil lawsuit"? They also think, because it is a "civil lawsuit," George Zimmerman can be forced to testify against himself. Just google "zimmerman" and "civil lawsuit."
My guess is George will stand his ground when/if the feds came after him. I think this for a few reasons.
First, while some may view George as a bumbling do gooder, I view him a little different. At the end of the day, HIS neighborhood was under siege by Obama's children - and, as far as I can tell, he was the only one in the development who didn't live his life in fear of assholes and f*ing punks. Say what you like, but I bet he is pretty stubborn.
Second - the media grabbed onto the profoundly suspect racial category "White Hispanic" as the original narrative began to unravel -which obscures the fact that, if anything, he is Jewish Hispanic (although a practicing Catholic). One of the most endearing or annoying cultural traits (depending on your perspective) of the Jews I have known (and I grew up in a heavily Jewish suburb in the North East) is that they are generally pretty bright, verbally aggressive, and stubborn as all get out - much like his brother Rob in fact who would routinely verbally ground and pound Piers Morgan on CCN.
(If you have never seen him - Rob is very polished, deals well with media, and appears to have a very high level of verbal ability.)

Finally, George has an awesome legal team that, given enough financial resources, could go toe to toe with the Feds in court and in the press. Keep in mind the Feds really just over charge and outspend and grind down defendants - it's not like there is anyone in the DOJ better than O'mara. If the trial showed anything is that State Prosecutors, even the good ones, are not particularly great.
Which comes to the issue of Money: Zimmerman has already raised hundreds of thousands for his defense without much effort. As someone said - write a book, go on Rush, Hannity, etc., as well as the news and talk shows. If he did this in conjunction with actively soliciting donations for his defense, I bet he could raise several million without much effort.
Every second that George or his proxies are on the offensive, on the television, and in peoples faces telling his story - it will become that much harder for the average voter to ignore the administration's tacit support of what amounts to racially driven low level genocide in the form of persistent violent crime against whites (and everyone else, it seems) by underclass blacks like Trayvon.

Come again? Tracy Martin is a long-haul truck driver. I think that is likely pretty near the workforce median in terms of compensation and skill level. Sybrina Fulton is an official of the housing authority in Miami. Stephen Martin, Sr. is a retired military officer. Brandi Green lives in a neighborhood chock-a-bloc with the common-and-garden middle class (a retired teacher, an IT tech, a real estate sales agent, and an insurance underwriter are among her neighbors). Not sure about Alicia Stanley, but from her grooming and speech patterns, I would guess wage-earning office employee. Jahvaris Fulton is a college student. Trayvon Martin was not in any way shape or form 'underclass'. He was at the nexus of the common middle class and the prosperous working class.
Opening (or reopening) an investigation is not the same as bringing charges. This is just playing for time until the outrage settles down. Sort of like appointing a special committee to study a problem.

This case seems to be splitting off many white liberals from the blacks among the Obama supporters. The case for self defense is simple and obvious. Note to self: turn in Communist Party USA membership card. Kidding aside, good catch and those are interesting facts re: Martin's socioeconomic background I was not aware of. I followed the case pretty closely. Were any of these facts adduced at trial or widely available and I just missed it?
That being said, my class assumptions were based on Martin's behavior and I'm not convinced that the details you supplied really change the analysis in any fundamental way. It is Martin's behavior, what he became, that is most important. Clearly, whatever station the St. Skittles Express started at in life it sure as hell wasn't where it ended. It just makes Trayvon's descent into thug or, to use David's term, low class life and its attendant and corrosive characteristics/societal effects all that more depressing in that, perhaps, it could have been prevented somewhere along the line.
Also, the facts about Martin's background leads to a question that goes deeper into the heart of everything. For another, identifying himself as a "concerned citizen" might just as easily have been what triggered Martin to assault Zimmerman; "no snitchin'" For another, it's as likely as not that Martin was already set on his goal of assaulting and beating Zimmerman, and no action on Zimmerman's point this side of brandishing his firearm would have prevented Martin's determined course of criminal behavior. And brandishing a firearm, is IIRC, a crime in Florida. Maybe that's why the lead detective didn't mention the one obvious action that Zimmerman could have taken that would have been likely to stop Trayvon's criminal trajectory?

Aside from the fact Robert was articulate and confident and pointed out Pierce Morgan's irresponsibility (the man was still insisting on the train of events as MSM wanted it and which the trial showed to be false), I just can't see "smug" anywhere on him. It was his calling out of the MSM (Piece Morgan is just one mouthpiece) on its irresponsibility that made HuffPost so vindicative. Calling someone like Zimmerman a "racist", even by Huff Post definitions, makes MSM look as lying and manipulative as it really is, and doesn't anger me. It's too absurd. OTOH, calling the media "irresponsible" cuts too close to the truth. Appearing to be the all-knowing-parent-god-figure is the MSM's currency. Nobody with brains believes CNN, ABC, or NBC, NYT, WaPo, etc. It's actually v. easy to get many people to admit that. Be careful about taking celebrity and politicians' regurgitations seriously. They are like mechanical puppets when it comes to this. What they really think may be quite different, but since they have no character to say so even tactfully, they prove themselves worthless.

He did not instigate the attack. The attacker did. Zimmerman just walked behind him briefly, as a good neighborhood watchman should do. He then turned to leave and the attacker came up behind him. The rest is history.
Personally I am of the cowardly safari breed. I look up (certain) blacks, especially when I'm alone and it's dark, as dangerous and according the MSM & many "liberals" (for lack of a better word) not subject to rule of law.
But Zimmerman did not instigate it. You must be either lacking in any comprehension, or, more likely, you're a troll for MSM and like MSM, know exactly what you're doing.
